Scalia Replacement

February 18th 2016

The death of Justice Scalia has brought out the worst form of partisan politics amongst the republicans who are blatantly obstructing any action by President Obama to carry out his constitutional duty and nominate a replacement. Justice Scalia would be appalled at such distain for the clear instructions within the body of the constitution regarding the responsibilities of the sitting President. As a constitutional textualist, Scalia would insist that the President perform his duties in a timely manner as required. He would also insist the Senate promptly consider such nomination and act to make sure the Supreme Court Is properly staffed to continue its workload of cases. This is part of the design of our democracy. A system of checks and balances that ensures we don't fall into the trap of single party rule that would eventually result in autocracy. It seems the republicans don't subscribe to that basic tenet of the founding document of our nation. They apparently want to ensure complete dominance of their philosophy at all levels of federal and local government. That's not democracy it's dictatorship.
